Annotation The purpose of this article is clarifying the issues of the modality of laws in the languages of the Standard Average European. Some modern scientific publications in Russia devoted to language of law (the European languages) are under the “positivism” and “neopositivism” effect. In studies, opinions about the monomodality of the text of the law are predominated. In fact, the findings in these studies do not contain reliable data on modal means of expression in law of “necessity and obligation”. In these studies, the modal means are shown selectively, to confirm the hypothesis of the study. We believe that this discrepancy between the actual data on the linguistic means of expression of modality in legislative texts, distorts the perception of these texts by society. Linguistic studies on legal texts are accepted as “expert” by the legal community. This study proves the inconsistency of previously proposed conclusions about the modality of legal texts. The following research methods were used: a descriptive method for analyzing practical material; a comparative method for studying modal elements of languages; structural and functional analysis; contextual analysis. The study describes the grammar of the conditional construction of the legal norm, within which modal elements are realized. Modal means of legal texts have common and different both in the set of language means and in the number of units that make up a particular subsystem. Legal texts in comparative aspect are an example of mutual influence at the level of cross-linguistic contacts. The research is carried out in languages (English, Russian, Polish, German, French and Spanish).
